New York Gov. Kathy Hochul and Attorney General Letitia James are positioning themselves as defenders of New Yorkers’ rights in the face of an incoming Trump administration, yet their own records tell a different story. At a press conference, Hochul and James emphasized their plans to push back against President-elect Donald Trump, citing concerns over rights and freedoms they believe could be at risk under his leadership. However, critics argue that their track records show a disregard for individual rights within their own state.

Hochul’s announcement of the “Empire State Freedom Initiative” claimed to safeguard New Yorkers from federal policies related to immigration, labor laws, and environmental standards. She declared, “You try to harm New Yorkers or roll back their rights, I will fight you every step of the way.”

Yet, many recall that Hochul was an ardent supporter of COVID restrictions that curtailed the freedoms of businesses and individuals across New York. Her administration even considered measures that bordered on state-sanctioned surveillance of citizens online, drawing ire from civil rights advocates.

Similarly, Attorney General James, who has been vocal in her criticism of Trump, stated she was “ready to fight back” and prevent the state from “going backward.” However, since taking office, James has aggressively pursued legal actions against Trump, leading some to question her commitment to fair treatment under the law. Her lengthy investigation into Trump, which resulted in a substantial civil fraud judgment, has sparked accusations of political bias, with many suggesting her approach represents a weaponization of her office to target political opponents.

Critics argue that James’ relentless pursuit of Trump and Hochul’s support for controversial COVID restrictions demonstrate a selective approach to defending rights. Both leaders have been accused of undermining freedoms within New York while framing their actions as protective measures. Hochul’s backing of policies that some consider intrusive, along with James’ pursuit of a high-profile case against Trump, have raised concerns over whether their focus truly aligns with the interests of New Yorkers.

State Republican leaders voiced their disapproval, highlighting what they see as hypocrisy. State GOP chair Ed Cox stated, “This does not help New Yorkers. It’s bizarre to claim to be champions of rights while chipping away at freedoms right here at home.”

With both Hochul and James promising a robust opposition to Trump’s policies, critics are skeptical about their dedication to safeguarding rights. Many see their approach as political theater, aimed more at opposing Trump than genuinely defending New Yorkers’ liberties.
